CONTRACT OF EMPLOYMENT

THIS EMPLOYMENT CONTRACT (the "Agreement" ) is made on this ____ day of __________________ 20____.

BETWEEN:

1. [FULL NAME OF EMPLOYER ], of ____________________________________________, [Company Registration No. __________________] (the "Employer" );

AND

2. [FULL NAME OF EMPLOYEE] , of _________________________________________, and Ghana Card No. __________________ (the "Employee" ).

The Employer and the Employee are collectively referred to as the "Parties" and individually as a "Party."

BACKGROUND

WHEREAS:

1. The Employer wishes to employ the Employee in the Position specified in this Agreement.

2. The Employee has represented that they possess the qualifications, experience and ability necessary to perform the duties of the Position.

3. The Parties wish to record the terms and conditions governing the Employee's employment.

IT IS AGREED as follows:

1. DEFINITIONS AND INTERPRETATION

1.%2. Definitions

In this Agreement, unless the context otherwise requires:

"Business Day" means any day other than a Saturday, Sunday or public holiday in the Republic of Ghana.

"Commencement Date" means the date specified in Clause 2. 4 .

"Confidential Information" means all information relating to the Employer, its business, customers, suppliers, employees, operations, finances, trade secrets, intellectual property and any other information which is not publicly available.

"Employer Property" includes all documents, equipment, computers, electronic devices, software, records, keys, identity cards, access cards, passwords and every other item belonging to the Employer.

" Position " means the position specified in Clause 2 .2.

2.%2. Interpretation

Unless the context otherwise requires:

%2. R eferences to a person include an individual, company, partnership or other legal entity.

2. EMPLOYMENT, COMMENCEMENT AND PROBATION

1.%2. Appointment

The Employer hereby employs the Employee, and the Employee accepts employment with the Employer, upon the terms and conditions set out in this Agreement.

2.%2. Position

The Employee shall be employed in the position of ______________________________ (the "Position" ).

3.%2. Employment Status

1.%2.%3. The Employee's employment shall be:

Full-Time

Part-Time

Fixed-Term

Temporary

2.%2.%3. Where this Agreement is for a fixed-term appointment, the employment shall expire on ________________________________________ , unless terminated earlier or renewed.

4.%2. Commencement Date

The Employee's employment shall commence on ______________________________ (the "Commencement Date" ).

5.%2. Continuous Employment

Unless otherwise stated in this Agreement, the Employee's period of continuous employment shall commence on the Commencement Date.

6.%2. Probation

The Employee shall serve a probationary period of ______ weeks / months commencing on the Commencement Date.

7.%2. Purpose of Probation

During the probationary period, the Employer shall assess the Employee's:

1. Competence;

2. Qualifications and skills;

3. Conduct;

4. Attendance and punctuality;

5. Performance; and

6. Overall suitability for the Position.

8.%2. Extension of Probation

Where the Employer reasonably considers that additional time is required to assess the Employee's suitability for employment, the probationary period may be extended for a further period of ______ weeks / months , provided that the Employer notifies the Employee in writing before the expiry of the original probationary period.

9.%2. Termination During Probation

During the probationary period (including any extension), either Party may terminate this Agreement by giving ______ days' written notice.

10.%2. Confirmation of Employment

Upon satisfactory completion of the probationary period, the Employer shall confirm the Employee's appointment in writing, whereupon the Employee shall continue in employment subject to this Agreement.

11.%2. Failure to Confirm Employment

Where the Employer does not confirm the Employee's appointment before the expiry of the probationary period or any lawful extension thereof, the Employer shall notify the Employee in writing whether:

1. The probationary period is being extended; or

2. The employment is being terminated in accordance with this Agreement.

3. REMUNERATION, DEDUCTIONS AND BENEFITS
